The Supreme Court of India on Friday refused to direct the Delhi High Court to hear the Air Asia dispute in a time-bound manner. Although, it did request the Delhi High Court to hear the case as soon as possible. Earlier the Federation of Indian Airlines had moved to the Supreme Court to seek a direction to direct the Delhi High Court to hear the case in a time bound manner.
Earlier on October 27, the SC had said that it would hear the FIA’s plea seeking to expedite the hearing of its petition that challenged the license granting to Tata-Air Asia in violation of DGCA rules. A bench headed by Justice Anil R Dave had said that the matter would be heard after the court reopens following the Diwali vacations. FIA counsel Dushyant Dave had told the SC that the High Court had been adjourned 17 times in the last 2 years.
The SC had been informed that the agreement was a direct breach of the aviation policy as it places tata-Air Asia’s control in the hands of a foreign authority. Dave had told the court that matter was to be presented in front of a special bench, that had directed the Delhi Hc to hear the matter expeditiously.
