SC asks AAI to approach Delhi HC

New Delhi: The Supreme Court on Thursday asked Airports Authority of India (AAI) to approach the Delhi High Court for vacation of stay given by different high courts in the country on recovery of service tax.
Various companies including Jet Airways, Flemingo, Thomas Cook and Siddhi Vinayak Enterprises among others had challenged levy of service tax by AAI in the high courts of Delhi, Bombay, Madras, Karnataka, Kerala and Andhra Pradesh.
The high courts had stayed the recovery notices issued by the Authority.
A bench headed by Justice B N Agarwal asked the AAI to approach the Delhi High Court after its counsel Mukul Rohtagi said it was not able to recover service tax in view of the stay imposed on levy of service tax by various high courts.
AAI had moved the apex court seeking transfer of petitions apprehending that the high courts might give different interpretations on the same issue which would lead to "judicial disharmony".
