New Delhi: India’s Supreme Court has ruled that “deadwood” among the employees can be removed from service for persistent misconduct or inefficiency in the interest of the institution.
A Bench felt that such an order of termination if provided under the rules is valid and is different from termination of service of an employee on a specific charge of misconduct. The apex court passed the order while upholding the dismissal of a security assistant S.M.K. Khan by the Indian Airlines whose rules provided that an employee can be compulsorily retired (terminated) for unsatisfactory service even before the age of superannuation which is 58 years.
