For damaged luggage, state forum slashes Rs 25K relief to 1,500

Chennai: Baffled by the Salem District Consumer Disputes' Redressal Forum's "generous grant" of 25,000 to a complainant for damage to luggage despite the fact that he had provided insufficient proof to support his case, the state commission slashed the amount to 1,500. A bench of Justice M Thanikachalam, president and J Jayaram, member, judicial, passed orders on the matter.
Manish Thakkar of Salem alleged that two pieces of his luggage worth about 13,000 and 5,000 were damaged - the wheels and name tag were broken - on a Mumbai-Bangalore Deccan Aviation Limited (now Kingfisher Airlines) flight. Offered 750, Thakkar demanded the value of the luggage (18,000) along with a compensation of 80,000.
Though observing that Thakkar didn't produce the damaged baggage nor an estimate for its repair or prove its actual value, the district forum granted 10,000 towards damage, 10,000 for mental agony, in addition to 5000 as costs in December 2009. The airline challenged this order.
