HC relief to aircraft owners from octroi demand of MCGM

Mumbai: In a relief for aircraft owners, the Bombay High Court today quashed notices issued by Municipal Corporation of Greater Mumbai (MCGM) seeking octroi on import of aircraft into Mumbai. Jet Airways, Reliance Commercial Dealers Limited (RCDL) and Tata Engineering and Locomotive Company Limited (TELCL) had moved the High Court against the corporation's demand. Arguing for Jet Airways, senior counsels T Andhyarujina, E P Bharucha and Birendra Saraf said the aircraft were not "used, consumed or sold" in Mumbai, the condition that attracts the levy of octroi. MCGM had demanded octroi of Rs 28 crore from Jet Airways, while Rs 31 lakh had been recovered from TELCL. The division bench of Justices S A Bobade and R D Dhanuka today accepted the petitioners' arguments and directed that octroi recovered from TELCL be refunded. Senior counsel Janak Dwarkadas, for RCDL, argued that the entry of the aircraft was transitory.
