SC refuses to stay Airport Development Fee

New Delhi: The Supreme Court on Friday refused to stay levy and collection of the Airport Development Fee (ADF), currently being collected by GMR-led Delhi International Airport Private Limited (DIAL), and remanded the contentious issue regarding the validity of the fee to the Airport Economic Regulatory Authority Appellate Tribunal.
DIAL, which has been levying the fee since March 2009, reportedly charges Rs 200 and Rs 1,300 per embarking domestic and international passengers respectively, at New Delhi’s Indira Gandhi International Airport.
A Bench led by Justice DK Jain remanded the matter after the Centre told the court that it has now appointed Justice VS Sirpurkar as the chairman of the appellate body, which could not function earlier for being a headless body.
