Panaji: A resident of Varkhand, Atmaram Malji Kambli, has filed a writ petition before the Bombay high court at Goa, challenging the acquisition of land by the government for the Mopa airport, alleging that the government has no eminent domain to acquire his part of the land in Varkhand.
He further alleged that the powers are assumed by the government and the collector under the Land Acquisition Act, 1894, by making use of fraudulently-framed and -maintained documents.
The High Court and Supreme Court have held eminent domain to mean state power to acquire private property for public purpose.
