HC relief for Air India in 12-year-old criminal cases over ground handling services

Mumbai: The Bombay high court has come to the rescue of national carrier Air India, which was facing criminal prosecution in a 12 year old case, over violating contract laws on providing ground handling services to other foreign airlines. A division bench of Justice V M Kanade and Justice B P Colabawalla quashed criminal proceedings initiated by the Andheri metropolitan magistrate's court based on a complaint filed by the Labour commissioner.

"The settlement contract indicates that foreign airlines have entered into a contract in respect of ground handling services, with Air India and Indian Airlines; and they were authorised under the Regulations, 2000 to enter into such a contract,'' said the judges, adding, "(The labour commissioner), therefore, could not have prosecuted Air India for carrying out the activities of ground handling activities, which are legally permitted under the Regulations."
