HC dismisses PIL on reopening HAL airport

Bengaluru: The high court on Wednesday dismissed two PIL which sought for a direction to reopen HAL airport for commercial operations.

The airport was closed when Kempegowda International Airport (KIA) opened at Devanahalli in May 2008.

"Generally speaking, the courts do not, in exercise of their power of judicial review, interfere in policy matters of the state unless the policy so formulated either violates the mandate of the Constitution or any statutory provision, or is otherwise actuated by mala fide. There are no such infirmities present in this case," a division bench headed by acting Chief Justice Subhro Kamal Mukherjee observed. It rejected the PIL filed by Airport Authority Employees' Union and Association of Outsourcing Professionals in August 2008.

"We cannot strike down a policy decision taken consciously by the government merely because it has been submitted that a fairer or wiser policy could have been adopted. In certain matters, there can be varied opinions about the wisdom of the policy but the court is not expected to sit as an appellate authority thereon," the bench said.
