AAI nod must for slum rehab on Juhu land: HC

Bombay high court on Monday said a slum rehabilitation scheme cannot be implemented on a large plot of land near the Juhu aerodrome without the Airports Authority of India's (AAI) permission.

A bench of Justice Abhay Oka and Justice C V Bhadang heard a PIL by activist Babu Jagtap, whose contention is that a builder, Cosmos Reality Pvt Ltd, in collusion with officers of the BMC and the Slum Rehabilitation Authority (SRA) is trying to develop a 22,400 sq m property. The petition mentioned that a portion of the plot was encroached by hutments, which came to be called Indira Nagar and Nehru Nagar and that the property is reserved in the Development Plan for public purposes. It added that considering the shortage of space for the airport, the land is required by the AAI. Jagtap's advocate, Sushil Upadhyay, at an earlier hearing, told the court that the builder had entered into individual consent agreements with residents for implementing the redevelopment scheme. But Cosmos' advocate, Cherag Balsara, questioned Jagtap's bona fides, saying in his rejoinder Jagtap had mentioned that other builders were not given a chance.
