Mumbai: The Bombay high court on Monday deemed the termination of an Air India cabin crew member illegal and ordered the airline to reinstate him and pay 50% of the admissible back wages.
On April 30, 2015, Mayank Sharma was assigned on AI 966 Jeddah-Hyderabad-Mumbai flight. But he refused to operate the flight stating that the airline had rostered him in violation of the civil aviation regulator’s duty/rest norms—the flight commander refused to provide him mandatory 22 hours of uninterrupted rest. AI terminated Sharma’s services under one of its controversial rules which gave it the right to terminate any employee with a 30-day notice. “Instead of adhering to the safety rules, regarding uninterrupted rest…the respondents (AI and AI officials) falsely alleged that petitioner has deliberately refused to operate the flights on April 30 and two earlier occasions, and proceeded to brazenly terminate the services...in flagrant violation of the principles of natural justice,” said the HC order.
