Hyderabad: The baby girl delivered by a Philippines woman in an aircraft at the Rajiv Gandhi International Airport here may have been born on Indian soil but she may not be able to apply for an Indian passport. While her parents and Embassy officials from the Philippines have already started the process of preparing papers for the infant’s Philippine citizenship and other documents required for air travel back to the Philippines, passport officials from Hyderabad said both the parents of the baby girl are foreigners, which makes her ineligible for an Indian passport.
Officials point out that under the Citizenship Act, 1955, a person is Indian citizen by birth if both parents are citizens of India or one of the parents is a citizen of India and the other is not an illegal migrant at the time of the birth of the child. “Both the parents are foreign nationals, so where is the question of Indian citizenship? Usually, in such situations, there is a request from parents but in this case, there is no such question at all,” authorities pointed out.
Immediately after the child was born on May 8, the mother had approached the Philippines embassy officials. According to officials, after the release of the birth certificate from the Greater Hyderabad Municipal Corporation (GHMC), the embassy officials are expected to complete the formalities of preparing Philippine citizenship document for the infant by Thursday or Friday.
