15-day call for illegal buildings near airport

Mohali: Owners of 98 illegal structures within 100 meters of vicinity of the air force station here have been served final notice and demolition of such constructions will start after 15 days from now, said Deputy Commissioner Girish Dayalan said on Monday.
The DC said the government of India had issued a notification under Section 3(1) dated January 2010, whereby the it had notified that no building or structure shall be constructed, created or erected, or no tree shall be planted on any land within the limits of 100 meters from the crest of the outer parapet of the Air Force Station (AFS), Chandigarh.
A public notice was issued under Section 3(2) under the Works of Defence Act, 1903 by the collector on March 9, 2011 for Bhabat village. The Punjab and Haryana high court had also constituted a committee headed by chief secretary of Punjab last year to examine the status of illegal constructions within 100 meters of the periphery wall of the AFS.

The committee in its report said that structures were constructed before the date of publication of the notification in 2011. In line with the Act, the high court has ordered that these 98 structures be demolished immediately without payment of any compensation, after following the due process of law.
The DC’s notice reads, “That you are hereby given 15 days’ notice to either remove the structure or appear in person or through any authorized representative before the undersigned to submit any claims or objections in writing. In case no objections are received in this office within the stipulated time period, then it will be assumed that you have nothing to say in the matter, and the demolition of the said structure will be carried out without further notice.”
