Airline asked to compensate couple for flight cancellation

Ahmedabad: A consumer court in Porbandar has ordered budget carrier SpiceJet to pay Rs 45,000 to a couple for flight cancellation at the last moment and towards instant booking of tickets of other flight to their destination and other expenditure.
Complainant Makeshbhai and his wife Bhavnaben Bhundiya had booked two tickets of a Porbandar-Mumbai SpiceJet flight on September 8, 2017. They had paid Rs 5,098 for the two tickets. On the day of departure, they were informed by the airline that the flight was cancelled and were offered return on the tickets.
The couple took a taxi from Porbandar to Rajkot and paid Rs 5,200 towards fare. They then booked tickets in a flight from Rajkot to Mumbai and paid further Rs 32,000.
The couple filed a case against the airline for deficiency in service in the Porbandar District Consumer Dispute Redressal Forum. The airline defended itself by stating that the passengers were informed more than three hours before the time of departure. Moreover, the flight cancellation was due to a technical glitch. Flight cancellation due to these reasons cannot be termed as deficiency in service and the airline cannot be fined.
The couple demanded Rs 1.59 lakh in compensation for the flight cancellation. They argued that they had to reach Mumbai on time because their daughter had arranged a dinner at a five-star hotel to celebrate their marriage anniversary. They had to incur extra amount towards taxi fare and they paid six times more for airfare when they had to obtain tickets for a flight from Rajkot.
