Bombardier takes drastic measures in raid

Montreal: Last month, Montreal-based Bombardier used a court order to send a team of bailiffs under the direction of a supervising solicitor to search the West Island home of Simon Davies, the former senior director of structured finance for Bombardier Aerospace.
Bombardier seized allegedly incriminating information at Mr. Davies' home in Baie d'Urfé, according to documents filed in Quebec Superior Court.
The material included data about the company's aerospace customers; financing and financing proposals from third-party lenders; the status of ongoing sales negotiations; and the payments schedule on all business jets until 2012, according to the court filings.
The material also included marketing and sales strategies in the Indian and other markets and top-secret information about aircraft sales financing, the filings said.
In another judgment, the Quebec Superior Court upheld aspects of Bombardier's allegations against Mr. Davies.
The "file establishes prima facie that Mr. Davies, dissatisfied with his conditions of employment with Bombardier Inc., entered into discussions with [aviation finance firm] Guggenheim Aviation Partners strictly for the advancement of his personal career and, for that purpose, began disclosing to Guggenheim confidential information of Bombardier Inc., in part obtained by guile," the decision reads.
