Bangalore: The relatives of those who died in the May 22 air crash in Mangalore are likely to get a lesser amount as compensation.
Expressing concern over the “misinformation campaign” by a few groups that made the bereaved families hope for a higher compensation, HD Nanavati of Mulla & Mulla, a legal firm representing Air India, said the amount would differ in each case.
The alleged misinformation campaign had put the minimum compensation amount at Rs74 lakh each.
“The compensation has to be worked out separately for each case on ‘proof of loss basis.’ This is an exercise to retain the victims’ family members in the same financial position as they would have been in, if the victim was alive,” Nanavati told a press conference in Mangalore on Tuesday.
Clarifying that there was no mathematical model to arrive at the compensation to be paid, he said the process was based on the income of the victim, dependency and to some extent, his encumbrances and actual financial losses the family had suffered.
“The baseline calculations depend on the actual worth of the victim, and the liability his unfortunate death has caused on the family,” he said.
Nanavati told this newspaper that the airline was not liable to pay the entire compensation, if an error of judgment had led to the crash.
