Forfeiture notice: HC sends MIAL to revenue department

Mumbai The Bombay High Court on Wednesday directed Mumbai International Airport Pvt Limited (MIAL) to approach the state revenue department to contest the forfeiture notice issued to it by the Collector, Mumbai Suburban, on October 7 for alleged non-payment of non-agricultural assessment (NAA) charges and increased land revenue to the tune of Rs 133 crore.
Dismissing the MIAL’s petition, the Division Bench of Justice P B Majmudar and Justice R M Sawant held that the revenue department had the power to take a decision in this regard. Government pleader D A Nalavade told court that the notice was issued on October 7 and the MIAL had time till October 22 before it could take effect. The MIAL, therefore, has sufficient time to approach the revenue department, Nalavade said.
Under the Maharashtra Land Revenue Code, 1966, if a plot of land is converted from agricultural to non-agricultural, the owner of the land is liable to pay non-agricultural assessment charges to the collector.
However, the petitioner contended that as the Mumbai airport is situated on Central government land, it is exempt from paying the tax levied by the state.
