Chennai: A hotelier's bid to get the Madras high court direct the defence ministry to relax building norms near Chennai airport failed with the court holding that relaxation of rules cannot be demanded as a right. He wanted the permitted floor space index (FSI) - the ratio of built-up area to land area - raised to 1.5 from 0.5.
Justice K K Sasidharan, pulling up Ceebros Hotels Private Limited for having used various ploys, including recommendations from a member of Parliament, to get the rules modified, said: "It is only after exerting pressure through a sitting MP from Andhra Pradesh (Chinta Mohan), the hotelier has approached this court. He must prove a legal right and a corresponding duty on the part of the authorities to seek a writ of mandamus. Relaxation (of rules) is not a matter of right."
The company owns 1.4 acres of land on GST Road at Pallavaram, and it wanted to construct a hotel on the property. As the permissible FSI is just 0.5, it approached the defence ministry for permission to increase the built-up area to 1.5 times the size of the property.
