DGCA has the right to intervene: HC told

New Delhi: The Centre on Wednesday told the High Court that the Directorate General of Civil Aviation (DGCA) always reserved with itself the right to intervene in situations against fair regulation of aviation industry and, therefore, was well within its rights in slashing “exorbitant” check-in baggage fee being charged by some airlines leading to harassment of passengers.

The DGCA told a bench of Justice Sanjeev Sachdeva that it has been receiving representations from harassed passengers on how they were being subjected to unjust treatment by airlines asking them to pay as much as Rs 350 for even one kg of baggage over the allowed limit.
The court was hearing a petition filed by Federation of Indian Airlines (FIA), which has Jet Airways, SpiceJet, IndiGo and GoAir as its members, challenging the move of the government fixing a rate of Rs 100 per additional kilogramme.

As per the new regulation, the airlines would now charge Rs. 100 per extra kg till 20 kg instead of the current rate of Rs. 300 or Rs. 350.

The government said it had by a circular dated April 30, 2013 “unbundled various services from the ticket price.
