Why GoAir is going after former MD Wolfgang Prock-Schauer, IndiGo's prized catch

When no-frills airline IndiGo’s recently appointed chief operating officer, Wolfgang Prock-Schauer, left his previous employer, GoAir—after months of constant disagreements with the airline’s promoters at the Wadia Group—he may have thought he was closing a chapter in his career.

But Prock-Schauer hasn't finished his business with GoAir yet. The airline sued its former managing director in the Bombay High Court for alleged theft of confidential information within a week of him joining rival IndiGoNSE -0.36 %, Mint reported citing court documents.

A GoAir lawyer submitted sealed documents he said belonged to his firm and were stolen by Prock-Schauer, according to the Mint report. Citing an order, the report said Prock-Schauer’s lawyer said he would not “use and/or copy and/or publish and/or disclose any of the confidential information, trade secrets and/or know-how belonging to GoAir”. Subsequently, on 14 March, the court allowed Prock-Schauer’s lawyer to inspect the documents on condition that they be kept confidential, the report said.

According to the report, at the last hearing on 27 April, senior counsel Janak Dwarkadas appearing for Prock-Schauer said, “During the last court hearing, we parted with the belief that the petitioners wanted to settle the case but now the company don’t want to settle. If the company had indicated this earlier, we would have gone ahead with the matter.” The court will hear the matter again on 15 June.

Prock-Schauer had joined GoAir as CEO in June 2015 and was its managing director since April 2016. IndiGo is his third airline employer in India, after Jet Airways and GoAir — no other executive has worked in as many Indian carriers in top management positions. The Austrian has been the chief executive of British Midland International and Air Berlin (Germany/UK) in the past.

Citing sources, ET had reported in February that starting April-May 2017, there were disagreements between chief executive Prock-Schauer and the Wadias over issues of yields and induction of foreign pilots as commanders for the airline’s new Airbus A320 planes.
Wadias were unhappy about some new routes started by Prock-Schauer that were not making money, said some of the people ET had spoken to. The promoters were also not pleased with his decision to induct expatriate commanders, the people said, as that would inflate the salary bill for the airline. A foreign pilot gets up to twice the salary of his Indian peer.
GoAir hired about 40 expatriate commanders last year. Some people also supported Prock-Schauer, saying GoAir’s revenue per available seat kilometre — a measure of operational efficiency — was best in industry during April-June. “On the issue of pilots, there is no doubt that expatriates come at higher salaries, not conducive for a low-fare carrier. But GoAir had promoted and upgraded as many first officers as it could and there was no more room. Also, it’s common knowledge that there is a dearth of commander pilots in India,” a pilot at the airline, supporting the decision to induct foreign pilots, told ET in February.

Go Air sues its former MD Prock-Schauer for stealing data

Wolfgang Prock-Schauer, who left Go Air and joined IndiGo in February 2018 as COO has been sued by its former employer in the Bombay High Court for allegedly stealing confidential data.  As per the court's document, the alleged theft of information occurred within a week of him joining IndiGo.

As per the report, a 13 February court order shows that a GoAir lawyer had submitted sealed documents he said belongs to his firm and were stolen by Prock-Schauer. According to the order, Prock-Schauer’s lawyer said he will not “use and/or copy and/or publish and/or disclose any of the confidential information, trade secrets and/or know-how belonging to GoAir”.

Later on 14 March, the court had allowed Prock-Schauer’s lawyer to inspect the documents on the condition that they are kept confidential. The latest hearing on the matter was held on 27th April, where it was highlighted that the company doesn’t want to settle. Next hearing will be on 15th June.

At the latest hearing, senior counsel Janak Dwarkadas appearing for Prock-Schauer said, “During the last court hearing, we parted with the belief that the petitioners wanted to settle the case but now the company doesn’t want to settle. If the company had indicated this earlier, we would have gone ahead with the matter.”

Prock- Schauher had joined Go Air in June 2015 as it’s CEO and later in April 2016, he was appointed as the Managing Director. Recently, in February he had left Go Air on a sour note. His final months at the company were said to be marked by constant disagreements with the airline’s promoters at the Wadia Group. Apparently, there were disagreements between him and the Wadias over issues of yields and induction of foreign pilots as commanders for the airline’s new Airbus A320 planes.

Pilots report A320neo engine ‘sluggish' while revving to avoid close call in air

New Delhi:  In the latest incident involving Pratt & Whitney (PW) engines for the Airbus A320 Neo, one of them was reported to be "sluggish" when the aircraft needed it to rev to veer away from another plane dangerously close to it. The planes flew safely away from each other, but the pilot filed a report about this alleged under-performance and the Indian aviation regulator is probing it.
The incident happened on Monday afternoon when IndiGo's 6E 6488 (VT-IGK) was flying from Kolkata to Delhi and GoAir G8 585 was on its way from Mumbai to Patna. While the GoAir A320 new engine option (Neo, VTWGE) was descending from 37,000 feet to 33,000 feet and IndiGo's A320 (not a Neo) was at 36,000 feet in Varanasi airspace, the two planes breached minimum separation and came uncomfortably close.
Modern aircraft have traffic collision avoidance systems (TCAS) equipment that issue two types of advisories to pilots: traffic advisories (TAs) and resolution advisories (RAs). In the first step, a TA is issued to give an advance warning to crew of two planes that they are headed in the same direction. In the second stage, RA asks crew to take evasive action to avoid mid-air collisions.

IndiGo, GoAir resume full A320neo ops

IndiGo Airlines  and GoAir have resumed flights of all Airbus A320neo aircraft previously grounded due to issues related to Pratt & Whitney PW1100G engines, PTI newswire has reported.

In mid-March, the Indian Directorate General of Civil Aviation (DGCA) issued an order to each of the LCCs grounding eight of IndiGo's A320neos and three of GoAir's aircraft of the type. The move was a reaction to the Emergency Airworthiness Directive (EAD) issued in February by the European Aviation Safety Agency (EASA) that warned of In-Flight engine Shut-Downs (IFSD) and Rejected Take-Off (RTO) events for select Pratt & Whitney PW1100 Geared Turbo Fan-powered A320neo/A321neo aircraft.

According to carriers' officials, all of the previously grounded aircraft had their engines replaced and are now back in active service.

Gang posing as airline hiring staff dupes youth of Rs 2 lakh

New Delhi: A network of fraudsters who duped several youths seeking a job in the aviation industry is on the radar of Delhi Police. A probe was initiated after a youth complained of being duped of approximately Rs 2 lakh by men posing as recruitment agents for GoAir.
The complainant, Prabhat Chaudhary (19), told police that he was contacted by two people through an online job portal in December 2017 promising to get him a job as a cabin crewmember.
Chaudhary met the two men in a hotel at Mahipalpur in southwest Delhi on January 3 where he was asked to pay Rs 3.10 lakh. “I agreed to pay them only after getting selected. They agreed and took me to the airline’s office at Terminal 2 of IGI airport where a person took my interview,” he added.
The next day, the youth got a mail from the airline’s “recruitment department” informing him that he has been selected for the job. Chaudhary forwarded it to an email ID provided on GoAir’s website to seek confirmation regarding his selection. However, he claimed that he didn’t get any reply. When he sent another mail, he got a call from a woman who introduced herself as the HR head. She said that he would be soon told about the mandatory medical check-up.

The victim said that the “recruitment agents” took him to a private pathology lab in Janakpuri for medical examination. He met other candidates there and after getting assured handed over Rs 1.5 lakh to the recruitment agents. He promised to give the remainder amount when the training starts.
“They told me that the training would be done in Jammu, but when I researched I found that the airline had no base there. When I raised the question, they offered to take me to the airline’s Mumbai office for another interview,” the youth said, adding that the men paid for his air tickets.
The youth was taken to the GoAir office in Worli in Mumbai, but no interview took place. Later, Chaudhary got a mail stating that the training base had been shifted to Udaipur due to “geological conditions”.
“I received an air ticket for Udaipur and upon reaching I was boarded in a hotel along with other candidates. A man claiming to be an HR representative soon came and asked for Rs 50,000 as security deposit. When I offered a demand draft, they refused and asked for cash,” the complainant said.
He stayed in the hotel for three days, but no one from the company turned up. Later, the phone numbers of the agents was found switched off. He returned to Delhi and lodged a complaint at Vasant Kunj (north) police station.

Over 2-hour wait on board for take-off leaves flyers fuming

Pune: Altogether 177 flyers on board a were made to sit in the aircraft for over two-and-a-half hours after boarding because of a late on Tuesday night.
Airline officials said the passengers were asked to remain seated, following detection of the glitch, instead of being de-planed and taken to the terminal building as the process could have caused further delay.

The flight was supposed to take off from the Pune airport for New Delhi at 8:55pm. It finally left Pune at 11.30pm, leaving most of the flyers fuming.

“Superb experience. The flight was supposed to reach Delhi at 11:20pm but took off from the Pune airport at 11:30pm. And coffee and two biscuits are complimentary,” a passenger tweeted.

“Flight G8172 is halted at the Pune airport in the name of technical constraints. Please let us de-board,” another passenger said. “Now we don’t have any food in the plane and still we are in Pune airport. We want to de-board but no one is allowing to,” the passenger added.

A GoAir spokesperson said, “Flight G8172 (PNQ – DEL) was delayed due to a minor technical glitch. While the issue was being addressed, all passengers were taken care off and served refreshments on board. GoAir sincerely regrets the inconvenience caused to its passengers because of the delay.”

Though the spokesperson did not elaborate the nature of the glitch, he said the passengers left for New Delhi in the same aircraft.

A passenger, who agreed to speak to TOI on the condition of anonymity, said the wait was frustrating. “The airline officials did not tell us anything at first about the delay. After quite some time inside the aircraft they said there was a technical problem. It is frustrating when you have entered the aircraft, taken your seat and are ready to fly but the flight continues to wait for hours,” he said.

“Some passengers lost their cool. Why didn’t the airline de-board the passengers and shift us to the terminal building? We could have waited there and move around,” the passenger said.

Don't follow intl norms blindly, use mind: Bombay HC on A320neo grounding

Mumbai: The Bombay High Court on Monday said that the Directorate General of Civil Aviation (DGCA) must not "blindly" follow international guidelines on air safety but must use its own "independent mind" to ensure the safety of passengers.

A bench of Justices Naresh Patil and GS Kulkarni also asked the DGCA to take appropriate steps to ensure that the modified engines in the affected aircraft belonging to Indigo Airlines and Go Air met with requisite safety standards.

The bench was hearing a Public Interest Litigation filed by a city resident, Harish Agarwal, seeking appropriate directions to the civil aviation authorities over the recent reports of certain 'Pratt & Whitney engines', that power A320neo planes, being more susceptible to engine failures.

The directions came after the Union government, through its counsel, Additional Solicitor General Anil Singh, told the bench that it was satisfied with all efforts made by the DGCA on the issue.

Singh filed an affidavit in court stating that the DGCA had ordered for the grounding of all such aircraft that had one or more affected P&W engines.

"We have checked all remedial steps taken by the DGCA and are fully satisfied. DGCA's imposes far more stringent criteria for certification of airworthiness of engines powering the aircraft," Singh said.

"Though the European Air Safety Authority (EASA) permits an aircraft with one affected engine, and another safe one, to continue operating, the DGCA has grounded even those aircraft that had just one affected? engine and the other was working fine," Singh said.

However, the bench asked whether the Union government was content with just grounding the aircraft.

"Are you ensuring that all A320neo planes are using safe engines? What about checking the airworthiness of the new engines that are being used to replace the flagged P&W engines? Don't just blindly follow international guidelines. Use your own discretion, based on Indian conditions and safety requirements, to ensure passenger safety," the bench said.

Good news for IndiGo, GoAir, A320 Neos back after being grounded

All 14 Pratt & Whitney engine-powered Airbus A320 Neo planes of the two budget carriers -- IndiGo and GoAir -- which were grounded between February and March this year due to safety concerns are now back into operation, officials said. Of these 14 planes, 11 were of IndiGo and three of the Wadia group-promoted GoAir.

None of the 11 A320 Neo planes fitted with P&W engines which were taken out of operation due to the engine glitches are now on ground. All these planes are back into service, an IndiGo official said today. A GoAir official also said that its three Airbus A 320 Neos which were grounded by the regulator DGCA on March 12 are now flying again.

However, spokespersons of both IndiGo and GoAir were not available for comments.

In February, three IndiGo aircraft, with both faulty engines, were grounded. This followed the European Aviation Safety Agency (EASA) issuing an emergency airworthiness directive on February 9 after a few occurrences of aborted take-off and in-flight shut down on A320 Neo fleet worldwide.

On March 12, the Directorate General of Civil Aviation (DGCA) ordered grounding of 11 A320 Neo planes fitted with faulty P&W 1100 engines having serial number of 450 and beyond, citing safety concerns.

The DGCA cracked the whip after an IndiGo flight bound for Lucknow returned to Ahmedabad within 40 minutes of getting airborne due to a mid-air engine failure on March 12.

Following the grounding of the aircraft, while IndiGo cancelled a total of 776 flights between March 1 3 and April 2, GoAir did not operate 336 flights during the period.

Earlier this month, government had informed Parliament that 11 of these 14 A320 Neo aircraft had started flying again after change of engine.

Over 1000 cancelled flights in 20 days due to engine fears

Following the grounding of 14 aircrafts, Airbus A-320 neo planes powered by certain Pratt and Whitney engines, more than 1,100 flights of IndiGo and GoAir have been cancelled in 20 days between March 13 and April 2, reveals data provided by the civil aviation ministry.

The Directorate General of Civil Aviation (DGCA) had in the second week of March announced the grounding of A320 neo aircrafts citing issues relating to the safety of passengers. In February 2018, the European Aviation Safety Agency (EASA) had also imposed similar restrictions due to instances of engine failures in A320 neo engine.

The data of civil aviation ministry reveals that 776 flights of IndiGo and 336 of GoAir were cancelled in the period mentioned above. This had also resulted in discomfort to several fliers as their travel schedule had to be changed or were given refunds after they opted for cancellation of their respective tickets.

The data also reveals that as of now 11 of the total 14 aircrafts that were grounded have resumed services after changing their engines. However, these cancellations of 1,112 aircrafts were out of the total scheduled flights of around 26,000 of both IndiGo and GoAir.

Meanwhile, IndiGo in a statement, said, "During this period IndiGo operated more than 21,000 flights. Our cancellations did not exceed 3.6 per cent of our total schedule and passengers were informed well in advance. All customers were re-accommodated and assisted." However, GoAir did not reply.
