‘Air India Violated NALSA Judgment’, Anand Grover Submits For Transgender Woman Excluded From Cabin Crew Selection

Senior Counsel Anand Grover, appearing for Ponnuswamy , contended that Air India has not complied with the 2014 apex court judgment in NALSA according recognition to transgenders.
Submitting that a separate category for the third gender was not provided for by the airline in the application form, Mr. Grover argued, “She has produced the gazetted certificate showing that she is a transgender. Because NALSA was not complied with and a separate category not created, she had to apply as a woman”
Indicating that the petitioner was rejected at the stage of the Group Discussion (GD) & Personality Attitude Test (PAT), he advanced, “She is a transgender who was born a male and now, after undergoing the sex change operation, identifies as female. How can she be expected to have a clear complexion and make herself physically appealing as a woman?”
